91 Carver 430 named Lady Jean in Canada

Postby kfehriba » September 23rd, 2020, 2:21 pm

Hello all,

I have a deposit on a boat that will be surveyed next week but I found out that it was previously owned in Keswick, Ontario, Canada and was named Lady Jean. The one problem I have is that there is no ownership/maintenance history on this boat (it was in marina inventory when it went through bankruptcy in 2015). I was hoping that maybe someone knows someone who might know any of the previous owners of this boat that might be able to fill in any history/maintenance history for me.

Thanks,
Kent

Welcome aboard.
If you have a hired a good surveyor, you should be alright. Full survey including engines and genny, correct?
Thanks

Welcome aboard Kent. Oh boy, I don't mean to put a scare in ya but I know the company you're talking about and I can tell you there was a lot of shady dealings with their inventory going on prior to the bankruptcy; same boats being sold to several buyers, insufficient paperwork/trail, etc. It got pretty messy, especially in the courts! I still hear about the odd ownership dispute even now. There's gotta be something you can do to trace and ensure there was a proper/legal ownership exchange leading back to 2015.

Yes. Full survey, and a separate day of survey with a Cummins field tech for doing engines/transmissions/genny.

Can you get a clean title or coast guard documentation on it?

Another perspective is who are you buying it from? Is it actually owned by a bank? If so, they would have done their due diligence to gain legal ownership before selling. Ask to see the title before transaction closes, look for any subsequent lien holders and demand satisfactions before closing. If it is owned by a bank, contact their "special assets" division to make sure the story makes sense. As far as condition, sounds like you have the right survey team in place, as long as you hired them. Don't use a surveyor provided by a seller/broker. Conflict there. Good luck...proceed with caution. 8-) er
